Judge tosses COVID-related lawsuit against former New York governor

A federal judge has thrown out a COVID-19-related wrongful death lawsuit against former New York Gov. Andrew Cuomo, CBS affiliate WRGB reported Sept. 30.

The lawsuit was filed in 2022 by family members of nursing home residents who died during the COVID-19 pandemic; they had accused the Cuomo administration of undercounting nursing home deaths. 

Mr. Cuomo testified before Congress on Sept. 10 regarding his administration's COVID-19 nursing home policies.

He testified that his staff was never told to undercount nursing home deaths and that numbers reported at the time were unclear due to the rolling nature of the updates his administration received.
