Georgia's Phoebe Putney Health Says FTC is "Meddling" in Transaction

Phoebe Putney Health System in Albany, Ga., has filed briefs with the 11th Circuit Court of Appeals to uphold a district federal court ruling clearing the way for the purchase of Palmyra Medical Center, also in Albany, according to a local WALB report.

Late last month, the Federal Trade Commission filed a 52-page appellate brief explaining why the it believes U.S. District Court Judge Louis Sands did not make the right decision in his June 27 ruling that stated Phoebe, which is operated by the Hospital Authority of Albany-Dougherty County, was immune from FTC oversight.

Now, Phoebe CEO Joel Wernick has said the FTC is "meddling" by objecting to the transaction.

"This transaction is between a willing seller, HCA, and our community's Hospital Authority. We are looking forward to the court's ruling. We believe the U.S. Supreme Court has made it clear this transaction is beyond FTC meddling," Mr. Wernick said in the report.
