FTC Files Brief With Court of Appeals in Phoebe-Palmyra Case

The Federal Trade Commission has filed a 52-page appellate brief with the U.S. 11th Circuit Court of appeals regarding Albany, Ga.-based Phoebe Putney Memorial Hospital's potential acquisition of Albany, Ga.-based Palmyra Medical Center, according to an Albany Herald report.

The brief explains why the FTC believes U.S. District Court Judge Louis Sands did not make the right decision in his June 27 ruling that stated Phoebe was immune from FTC oversight, the report said.

According to the report, the brief said the district court's ruling could "provide a roadmap for private parties wishing to bypass any antitrust scrutiny."

The 11th Circuit Court of Appeals recently granted the FTC a temporary injunction to block Phoebe's proposed $195 purchase of Palmyra, and the hearing on the merger is expected to take place in October.
