Justice Department probes healthcare AI

The Justice Department is investigating the healthcare industry's use of AI in patient records that influences physicians' treatment recommendations, Bloomberg Law reported Jan. 29. 

Prosecutors have been issuing subpoenas to pharmaceutical and digital health companies to probe the role of generative technology in potential anti-kickback and false claims violations. 

The prosecutors are specifically looking at how EHR vendors are incorporating advanced AI tools to connect patients with specific drugs and devices. According to the news outlet, GSK, AstraZeneca and Merck have disclosed receiving subpoenas related to electronic medical records, but resolutions with the Justice Department have not been announced.

Anonymous sources say that the Justice Department's attorneys are in the early stages of asking general questions and may still be formulating a strategy.
