HHS Proposes Final Rule for EHR Disclosures

The Department of Health & Human Services has submitted a proposed final rule for the accounting of disclosures of electronic health records, according to an update by the Office of Information and Regulatory Affairs.

Under the Health Information Technology for Economic and Clinical Health Act, HHS will issue a rule that would modify the HIPAA Privacy rule, which would outline exactly what healthcare providers will be responsible for when patients ask for disclosures in their EHRs. Currently, legislation does not allow the disclosure of any treatment, payments or healthcare operations. However, the HITECH Act extends disclosure rights, spanning the previous three years, to patients if the covered entity uses an EHR.

All proposed rules are submitted to the Office of Management and Budget. The review process before finalizing any rules could take from one to 90 days.
