CMS Releases Final Rule on CHIP, Marketplace Provisions and Medicaid

CMS has issued a final rule amending CHIP, marketplace provisions and Medicaid. 
 
The rule amends language in provision 440 of the Patient Protection and Affordable Care Act to reflect new minimum standard requirements in the Act, changing the phrase ' benchmark and benchmark-equivalent plan' to 'alternative benefit plan'. It also simplifies Medicaid premium and cost sharing requirements to allow flexibility in state cost-sharing. 
 
The rule also specifies standards for authorized affordable insurance exchange representatives, sets forth requirements for eligibility and enrollment in employer-sponsored minimum essential coverage plans and amends eligibility provisions for the affordable insurance exchanges with the intent of allowing state discretion for affordable insurance exchange design. 
 
Finally, the rule notifies the public that CMS is considering extending the date for which Medicaid and CHIP regulations are to take effect, currently Oct. 1, 2013.
