The American Hospital Association, 340B Health and the American Society of Health-System Pharmacists filed a motion asking for permission to submit an amicus brief to support the defendants in a lawsuit brought by Novartis Pharmaceuticals.
The lawsuit, filed by Novartis against Missouri's attorney general and members of the Missouri Board of Pharmacy, challenges a new state law expanding the discount requirement of the 340B program to include for-profit pharmacies. Novartis argues that the way the law forces the organization to discount drugs will further harm its business model.
In the motion, filed Aug. 29 and posted on the AHA's website, the three organizations ask that the court dismiss Novartis' lawsuit and to prevent the obstruction of the new law, which the organizations say protects the 340B program.
