Tuomey Hospital to Pay $45M for Stark Violations, Face New False Claims Act Violations Trial

A judge has ordered Tuomey Hospital in Sumter, S.C., part of Tuomey Health System, to pay nearly $45 million for violating the Stark Act, according to The Item of Sumter.

In April, jurors found Tuomey Hospital guilty of violating the Stark Act through employment agreements with physicians for its Outpatient Surgery Center.

The jurors had cleared the facility of $227.5 million in False Claims Act violations stemming from allegations that the hospital submitted claims resulting from referrals, which violated self-referral law. But a U.S. District Judge has said the government is entitled to a new trial regarding the False Claims Act violations after admitting he made a mistake excluding some testimony during the earlier trial, according to The Item report.

If Tuomey Hospital is found guilty of False Claims Act violations and faces a monetary penalty, there will be no double recovery.
