Ohio Judge Okays Third Reform Law Challenge

A federal judge in Ohio said a lawsuit challenging the healthcare reform law can proceed, making it the third challenge to go forward so far, according to a report by the Hill.

The judge agreed to hear the lawsuit's arguments that the law's individual mandate to buy insurance violates the Commerce Clause of the Constitution. But he rejected claims that the law violates freedom of association under the First and Fifth amendments, the due process clause of the Fifth Amendment and the right to privacy.

While three lawsuits against the law are moving ahead, two have been dismissed. The judge acknowledged the cases would end up with the Supreme Court.
