AHA Urges Supreme Court to Hear Case on False Claims Act

The American Hospital Association is urging the U.S. Supreme Court to reverse a lower court's False Claims Act decision, saying it would encourage dubious lawsuits, according to a report by AHA News Now.


In an amicus brief filed in Ortho Biotech Products v. United States ex rel. Mark Eugene Duxbury, the AHA said that if the First Circuit Court of Appeals' decision were not reversed, it would undermine two key requirements for FCA actions:

  1. That private individuals attempting to bring lawsuits not trade on fraud allegations already disclosed to the public; and
  2. That they have specific knowledge of false or fraudulent claims before filing the case.
