Milwaukee Health Services Suing Tech Firm Over Denied Access to EHRs

Milwaukee Health Services has filed a lawsuit claiming technology provider Business Computer Applications has deliberately locked MHS out of its own electronic health records following a billing dispute, according to a report in Courthouse News.

MHS claims the firm refuses to restore access until a payment of $285,000 is received, according to the report. The suit claims MHS has been unable to access electronic patient records since July 1.

The claim has been filed under Wisconsin's Computer Fraud and Abuse Act, which requires the release of patient records "to healthcare providers when the provider is rendering assistance to patients, the provider is consulting patients regarding their health, the patient's life is in danger and the information is needed to render assistance and the provider prepares or stores those patient records," as cited in the report.
