U.S. District Judge David Campbell in Phoenix ordered that HHS re-review a waiver application for Arizona's Medicaid copay demonstration project within 60 days, claiming the department's original approval did not offer adequate explanation, according to a report by the Daily Courier.
Arizona's project charges copays for Medicaid beneficiaries ranging from $1 for physician visits and $30 for nonemergency hospital visits. The copays apply to less than 90,000 of the 1.3 million Arizonans on Medicaid, according to the report.
The copays will be short-lived, however; the Patient Protection and Affordable Care Act will outlaw them beginning next year.
