The lawsuit claims Sonjay Fonn, DO, the owner of Midwest Neurosurgeons, and his fiancée Deborah Seeger incorporated a company, DS Medical, to serve as the distributor of medical devices and supplies to Dr. Fonn and his neurosurgery practice.
According to the complaint, once DS Medical began operating, Dr. Fonn began using more spinal implants in each of his surgeries and began performing more surgeries to get exorbitant commissions from medical device manufacturers.
The lawsuit was originally filed under the qui tam, or whistle-blower, provision of the False Claims Act by several physicians, a spinal implant sales person and a former employee of Midwest Neurosurgeons.
