Federal officials are investigating several Atlanta-area hospitals owned by Dallas-based Tenet Healthcare for potential violations of the Anti-Kickback Statute and False Claims Act, according to an Atlanta Business Chronicle report.
In its filings with the Securities and Exchange Commission, Tenet said it has received a subpoena from the HHS and Office of the Inspector General. The agencies requested documents from January 2004 through May 2012 related to the relationships between several Tenet hospitals and an unaffiliated company called Hispanic Medical Management.
The hospitals named in the document are Atlanta Medical Center, South Fulton Medical Center (now known as Atlanta Medical Center – South Campus), both in Atlanta. Also named are North Fulton Regional Hospital in Roswell, Ga., Spalding Regional Hospital in Griffin, Ga., and Hilton Head (S.C.) Hospital.
The hospitals contracted with HMM for translation, marketing and Medicaid eligibility determination services, Tenet said in the report. The for-profit hospital company said it understands the investigation focuses on whether "the arrangements violated the federal Anti-Kickback Statute and False Claims Act," according to the report. Tenet also said it is cooperating with the government's review.
