Mark Midei, MD, and his attorneys are asking for a judge to let the former cardiologist's defamation lawsuit against St. Joseph Medical Center in Towson, Md., go to trial, according to a Baltimore Sun report.
A circuit court judge has made no decision. The suit stems from allegations, beginning in 2009, that Dr. Midei implanted hundreds of unnecessary cardiac stents into patients. Since then, the cardiologist has lost his medical license and faces more than 200 lawsuits filed by patients.
Dr. Midei's attorney claims St. Joseph is scapegoating the physician for the hospital's financial and reputational problems. The defamation suit includes four counts and Dr. Midei seeks $60 million for each.
The hospital's attorneys say the defamation suit is null because Dr. Midei signed a release absolving the hospital from responsibility for any consequences of his activity at the hospital. That release was signed when he resigned from his position in November 2009.
