A lawsuit filed by Avera St. Luke's Hospital in Aberdeen, S.D., against an Ohio physician seeking compensation for his role in a 2008 procedure that led to a malpractice payout has been dismissed, according to an Aberdeen News report.
The lawsuit sought to recover part of a settlement paid by the hospital on behalf of Adil M. Karamali, MD, after a patient claimed improper care for his heart attack led to him needing a heart transplant, according to the report. St. Luke's lawsuit claimed the patient's injuries had been caused by Dr. Karamali, who had been filling in temporarily at the hospital, and therefore Dr. Karamali owed the hospital partial reimbursement for the settlement. Dr. Karamali has denied any wrongdoing, according to the report.
The trial had been set to begin next week, however, both sides have agreed to dismiss the case and pay their own court costs.
