The U.S. District Court for the Southern District of Alabama has ruled in favor of Accretive Health in a class-action lawsuit alleging the company violated the Fair Debt Collection Practices Act.
PlaintiffMahalaChurch filed a putative class-action lawsuit against Accretive on Nov. 24, 2015, for a debt the firm attempted to collect on behalf of ProvidenceHospital in Mobile, Ala.
The suit claimed Accretive sent a debt collection notice to Ms. Church that failed to include certain disclosures required by the FDCPA when a debt is in default, according to court documents. Accretive argued the debt was not in default at the time it was obtained from ProvidenceHospital, therefore it was absolved of any default disclosures mandated under the FDCPA.
The court upheld a lower court's ruling in favor of Accretive.
