California Supreme Court Denies Review of Sutter Health, Eden Healthcare District Case

The California Supreme Court has refused to review an appeals court decision in an ownership dispute between Sutter Health and Eden Township Healthcare District for San Leandro (Calif.) Hospital, according to a Mercury News report.

The appeals court decision in question is from December 2011 when the California 1st District Court of Appeal ruled in favor of Sutter Health, deciding that Eden Healthcare District did not have a valid case. Eden Healthcare District's case had claimed that Sutter Health's purchase of San Leandro Hospital was invalid because two members of the board who approved the transaction had conflicts of interest.

According to the report, Eden Township Healthcare District is challenging Sutter Health's ownership of San Leandro because the system plans to convert San Leandro from an acute-care emergency service facility with a 24-hour ER and inpatient care, to an acute rehabilitation center. The board is concerned for the San Leandro community's future access to healthcare services without a local emergency room.
