Analysis of Comments on ACOs Finds Certain Regulations Sparked More Concern Than Others

After the public comment period for accountable care organizations ended June 6, MedeAnalytics compiled and analyzed recommendations from various healthcare organizations on the major factors of the ACO economic model.

The analysis of public comments was based on organizations' responses to nine major factors that function as the primary drivers of the ACO model:
• Quality measures
• Minimum Savings Rate and threshold
• Shared savings rate
• Withholding
• General provision of downside risk or shared loss
• Minimum loss rate
• Caps on shared losses
• Program duration

The analysis found a majority or consensus recommendations in a few key areas, such as quality measures. All seven organizations recommended reduction in the number of quality measures along with a three-year phase-in period. Four of seven organizations recommended the elimination of the proposed rule stating CMS would withhold a portion of the earned performance payment. All seven organizations also recommended the maximum shared savings rate be increased for track 1 and track 2.
