AMA Issues Response to Proposed ACO Antitrust Policy

The American Medical Association has submitted its comments to the Federal Trade Commission and Department of Justice on the proposed policy regarding antitrust regulation of accountable care organizations, according to an AMA news release.

The AMA has said existing antitrust rules can hinder physicians from becoming part of an ACO, particularly physicians in small practices.

"While we appreciate this first step in proposing necessary changes to antitrust rules, further clarification and modifications are necessary to ensure physicians in all practice sizes can form an ACO,” AMA President Cecil B. Wilson, MD, said in the release. "As proposed, the FTC and DOJ policy on ACOs simply does not go far enough to level the playing field, leaving small physician practices at a disadvantage compared to hospitals and dominant insurance companies."
