NLRB Rule for "Speedy" Union Elections Forthcoming

The National Labor Relations Board has voted 2-1 to draft and circulate a final rule that would amend certain election procedures, according to an AHA News Now report.

In June, the board published in the Federal Register a Notice of Proposed Rulemaking, which proposes amendments to existing rules and regulations governing procedures in representation cases. The board received more than 65,000 written comments on the proposal and heard testimony from 66 speakers at a two-day hearing in July.

Yesterday, the board voted to start work on finalizing some amendments, including consolidation of all election-related appeals into a single post-election appeals process to eliminate delay in holding elections. The board also voted to finalize an amendment that would make board review of post-election decisions discretionary rather than mandatory.

A final rule will be drafted and circulated among board members for a subsequent vote. The board announced it would continue to discuss remaining provisions in the June Notice of Proposed Rulemaking, including electronic filing of election petitions and other documents.
