Alabama Bill to Shorten CON Process

A proposed Alabama bill would allow appeals of certificate of need decisions to go directly to the Alabama Court of Civil Appeals instead of going to Circuit Court first, according to a Birmingham News report.

The bill would also limit hearings before administrative law judges to 45 days and would apply to both new appeals and appeals pending.

An appeal of a CON decision that approved Birmingham, Ala.-based Trinity Medical Center's plan to move to a new site is pending. The Circuit Court judge ordered regulators to receive new evidence and reconsider their approval. Attorney Jim Williams said the new bill may allow Trinity to avoid this requirement, according to the report.
