Rep. Jim McDermott, D-Wash., has sent a letter to the HHS Office of Inspector General, urging it to renew its safe harbor provision that permits certain donors to share electronic health record information with physicians if certain requirements are met.
The provision is set to expire Dec. 31, however, Mr. McDermott urges its extension on the basis that the provision allows for care coordination, which leads to reduced costs and greater collaboration.
According to The National Law Review, speculations are circulating that CMS and the OIG have submitted proposals to the Office of Management and Budget, which seek to extend the safe harbor provision. If CMS and OIG extend federal protection for certain EHR donations, other states may follow suit.
