McKesson hit with sanctions in Telephone Consumer Protection Act case

A California judge set discovery sanctions against McKesson in a class-action lawsuit alleging violations of the Telephone Consumer Protection Act, which governs appropriate use of telephone solicitations.

The case, filed in 2012 by Westerville, Ohio-based True Health Chiropractic, asserts that McKesson violated the act by faxing unsolicited ads to True Health. The judge ruled that McKesson's counsel had dragged its heels in complying with the discovery order and ordered McKesson to pay attorneys' fees and costs for failing to comply, according to Law 360.

The fax transmission in the case occurred in 2010. San Francisco-based McKesson has filed for transfer of venue from California to Ohio based on two similar filings from one company in Ohio and one in eastern Tennessee. The court is still evaluating the petition to transfer, according to the court documents.
