HHS has issued guidance on methods and approaches to de-identify protected health information in accordance with the HIPAA Privacy Rule.
Under the HIPAA Privacy Rule standard, health information is not individually identifiable if it does not identify an individual and if the covered entity has no reasonable basis to believe it can be used to identify any individual. HHS' guidance can assist covered entities in understanding de-identification, the general process by which de-identified information is created and options available for performing de-identification. For instance, two methods that can be used to satisfy the de-identification standard — expert determination and safe harbor — are covered in the guidance.
