Health IT vendors Allscripts and Medfusion completed the terms of a settlement over a legal dispute involving a breach of contract.
In 2009, the vendors entered a contract in which Medfusion would integrate its patient portal technology with Allscript' EHR platform. In 2014, Medfusion sued Allscripts over a payment dispute and unfulfilled responsibilities that resulted in a loss of $10 million for Medfusion. The agreement was terminated April 24, 2014.
"Allscripts intentionally concealed from Medfusion material information about reports of issues with use of the portal from end users," according to the complaint. "Rather than follow the agreed upon protocols for communicating such issues to Medfusion and giving Medfusion an opportunity to address an issues with its part of the portal, Allscripts unilaterally either waived or reduced fees owed by the end user for the portal, stopped billing the end user for the portal and/or allowed the end user to prematurely cancel its [end user agreement]."
Medfusion sought $5.46 million in damages from Allscripts.
Allscripts did not comment on the lawsuit at the time, telling Triangle Business Journal, "Our focus is, as always, on our clients and providing them with the best possible population health and healthcare information technology solutions."
Allscripts and Medfusion reached confidential terms to resolve all claims.
