White House aims to expand birth control coverage under ACA

The Biden administration aims to expand access to free birth control under the Affordable Care Act through a proposed rule issued Jan. 30.

The rule — issued by HHS, the Justice Department and Treasury Department — would remove an exemption that allows private health plans and insurers to deny contraceptive coverage on moral grounds. These exemptions were expanded in 2018 during the Trump administration. 

The proposed rule would leave an existing religious exemption in effect and create a new pathway for people enrolled in health plans at organizations that object to birth control to still receive free contraceptives from a healthcare provider.

Public comments on the proposed rule are due by early April.
