Non-Economic Malpractice Damages Cap Bill Makes Its Way to House Floor

A bipartisan malpractice reform bill aiming to cap non-economic damages at $250,000, titled the HEALTH Act, was approved by the House Judiciary Committee yesterday, according to an AHA report.

The measure will now make its way to the House floor. The Help Efficient, Accessible, Low-cost, Timely Healthcare Act was introduced last month by Reps. Phil Gingrey, MD (R-Ga.), Lamar Smith (R-Texas) and David Scott (D-Ga.).

In recent years, similar measures have been passed in the House but failed in the Senate. The bill is based on reforms enacted in California during the 1970s, according to the report.
