Temple University, Physician Agree to Pay DOJ $1.09M for Fraudulent Billing

Temple University in Philadelphia and Joseph J. Kubacki, MD, former chairman of the medical school's ophthalmology department, agreed to pay a combined settlement of roughly $1.09 million over Temple's voluntary disclosure of fraudulent billing.

Dr. Kubacki was convicted by a jury in August 2011 of 73 counts of healthcare fraud, 73 counts of false statements in healthcare matters and four counts of mail fraud. He was sentenced in March to 87 months in prison.

Trial evidence showed that from July 2002 through October 2007, Dr. Kubacki billed federal health programs for services performed by medical residents when he was not even present at Temple University Hospital. Along with his role as chairman, Dr. Kubacki was also an attending physician at the hospital.

The fraudulent billing amounted to roughly $1.8 million. In addition to his prison sentence, Dr. Kubacki was also ordered to pay Temple approximately $1 million in restitution.

Temple removed Dr. Kubacki from his positions in November 2007 and voluntarily disclosed the improper billing with the government.

Dr. Kubacki has agreed to pay $676,101 back to the government. Temple has agreed to pay $412,474.
