Youngstown, Ohio-based Forum Health and Akron Children's Hospital in Akron, Ohio, are going on trial today to argue for $8 million that was designated for former Tod Children's Hospital of Youngstown, Ohio, according to a Youngstown Vindicator report.
The Kikel Charitable Foundation, led by three sisters, left about $16 million to be divided equally and annually between Tod and St. Elizabeth Health Center's children unit in Youngstown, Ohio. When Tod closed in 2007, however, its payments were suspended.
Forum Health, which previously owned Tod, argues it deserves the money because it did not close the children's hospital but instead eliminated the name "Tod," which it claims is the trade name for Forum. In addition, Forum serves children in the same building that housed Tod.
Akron Children's Hospital claims it is Tod's successor, and thus deserves the money. Akron Children's Hospital bought Beeghly Medical Park in Boardman, Ohio, from Forum and, according to a court filing, all of Tod's neonatal equipment and the rights to the name Tod Children's Hospital.
