Members of Congress Urge Delay of New Medicaid DSH Rule, to Begin This Month

Fifty-four members of Congress this week asked HHS to delay implementation of the Medicaid Disproportionate Share Hospital audit and reporting rule to plan year 2012, according to a report by AHA News Now.

Without the delay, the audit and reporting rule would go into effect this month in many states. With the delay, CMS would have time to review state audits of Medicaid DSH payments and adjust the rules.

A letter from the lawmakers said the rule contains "potential disallowances for the upcoming state plan year" and "implements dramatic policy changes" beyond Congress' intent.
