The California Nurses Association/National Nurses United has filed a complaint with the National Labor Relations Board that alleges Sutter Health, based in Sacramento, conducted an illegal lockout following a one-day strike last month.
More than 23,000 nurses at more than 30 Kaiser Permanente and Sutter Health hospitals in Northern and Central California took part in a one-day strike. The Kaiser nurses went on strike in solidarity for mental health workers at Kaiser, who are in ongoing contract negotiations with the system. Sutter nurses are on strike over their own contract negotiations. In response, Sutter hired nurses on five-day contracts to replace nurses, who were locked out following the one-day strike.
In its complaint, CNA accuses Sutter of breaking federal labor law through employer fraud to justify the lockout and illegal retaliation against the nurses for going on strike. Sutter has not yet released a statement but maintains its contract with replacement nurses was to ensure continuous quality care for its patients.
During the five-day lockout, an unnamed replacement nurse at Alta Bates Summit Medical Center in Oakland administered a lethal medication dose that caused a patient's death.
