A Gooding County, Idaho prosecutor will not be filing charges against former CEO of North Canyon Medical Center Earl Fitzpatrick, who was terminated in September over a banking mistake, according to a Times-News Magic Valley report.
A check dated in April for $579.60 from St. Luke's Regional Medical Center in Boise, Idaho, was made out to "Partners in Healthcare Inc. DBA North Canyon Medical Center ATTN: CEO." The check, which should have been deposited in the hospital's account, was instead deposited into Mr. Fitzpatrick's personal account, according to the report.
The banking mistake was realized in July. Consequently, Mr. Fitzpatrick told St. Luke's Regional to debit his personal account. However, St. Luke's Health System, parent health system of North Canyon, placed Mr. Fitzpatrick on leave in August and then terminated him the next month. An unemployment insurance decision by the Idaho Department of Labor stated Mr. Fitzgerald "provided an explanation for depositing the check into his bank account and stated he was never made aware his job was in jeopardy due to his performance" and that St. Luke's "discharged [Mr. Fitzpatrick] for depositing a company check into his personal bank account and for unsatisfactory performance as the CEO."
Prosecutor Calvin Campbell, who was charged with handling the matter of the misplaced check by state police during Thanksgiving, said there was not sufficient evidence to show there was any criminal intent by Mr. Fitzgerald.
In response to the prosecutor's decision to not file criminal charges, Mr. Fitzpatrick said, "I don't know what the political motivations behind this were. These things happen at the executive level, but it was rather spiteful. I have to move on at this point."
