A circuit court judge has overturned Alabama's Certificate of Need Review Board's approval for Brookwood Medical Center in Birmingham, Ala., to build a free-standing emergency department in Hoover, Ala., according to a Birmingham News report.
After Brookwood received approval to build its emergency department last year, Trinity Medical Center, also in Birmingham, appealed the review board's decision, arguing that Brookwood had not followed the due process for filing a CON application.
According to the news report, proposed healthcare facilities must have published a notice for two straight weeks within the 30 days after filing a CON application. Trinity argued Brookwood did not post the notice for the required amount of time. The circuit court ruling affirmed Trinity's appeal.
An attorney representing Brookwood said the review board's approval was overruled due to "the slightest of technicalities." The hospital will file a motion for the circuit court judge to reconsider her ruling and, if necessary, file an appeal, according to the news report.
