Case Against Washington's Sunnyside Community Hospital Alleging Negligent Care Heads Back to Superior Court

An appellate court judge has overruled a Superior Court judge's decision to dismiss a lawsuit against Sunnyside (Wash.) Community Hospital alleging negligent care in the death of one of its internists, according to a Yakima-Herald news report.

In 2006, Sandra Wilson, MD, a contracted internist at Sunnyside Community, was treated by Terri Grant, MD, an emergency physician also at the hospital, for nausea, vertigo and speech problems. Dr. Grant prescribed Dr. Wilson with migraine medication, based on Dr. Wilson's history of migraines. According to the news report, Dr. Wilson later died, with physician concluded the migraine medication worsened an already existing narrowing of an artery at the base of her brain.

Dr. Wilson's father sued the hospital and Dr. Grant for loss of wages, payment of medical bills and pain and suffering. In that case, the high court tossed out the complaint. Two years later, an appellate court judge overruled part of that judge's decision, arguing Dr. Wilson's father may seek compensation for lost wages and medical bills but not pain and suffering, according to the news report.
