County Attorney Sues Kentucky's University Hospital Over Merger Documents

An attorney representing Jefferson County in Kentucky has sued University of Louisville today over its failure to turn over documents he requested on a proposed merger involving the school's University Hospital, according to a Courier-Journal report.

Mike O'Connell originally requested documents pertaining to the Louisville hospital's proposed merger with Louisville-based Jewish Hospital & St. Mary's HealthCare and Lexington, Ky.-based St. Joseph Health System on Nov. 3. Requested materials included minutes of board meetings and analyses of the deal's feasibility, advantages and disadvantages. His request was made under Kentucky's open records law, and Mr. O'Connell said he received some, but not all, of the documents sought, according to the report.

He filed suit in Jefferson Circuit Court. University of Louisville President James Ramsey is also named as a defendant in the suit, according to the report.

In a separate case, University Hospital filed suit earlier this month against the American Civil Liberties Union, a local newspaper and local news network after they requested merger documents. The hospital claims the documents requested are exempt from disclosure for various reasons, including that they are preliminary, proprietary and protected by attorney-client privilege.
